Supreme Court Strikes Down Defense Of Marriage Act, Paves Way For Gay Marriage To Resume In California.

In a 5-4 ruling, the United States Supreme Court justices strike down the Defense of Marriage Act, saying it is unconstitutional. NBC's Pete Williams reports.

In a pair of landmark decisions, the Supreme Court on Wednesday struck down the 1996 law blocking federal recognition of gay marriage, and it allowed gay marriage to resume in California by declining to decide a separate case.

The court invalidated the Defense of Marriage Act, which denied federal benefits to gay couples who are legally married in their states, including Social Security survivor benefits, immigration rights and family leave. Justice Anthony Kennedy, writing for the majority in a 5-4 decision, said that the act wrote inequality into federal law and violated the Fifth Amendment’s protection of equal liberty. “DOMA’s principal effect is to identify a subset of state-sanctioned marriages and make them unequal,” he wrote. Edith Windsor, the 84-year-old woman who brought the case against DOMA, said that the ruling ensured that the federal government could no longer discriminate against the marriages of gays and lesbians. “Children born today will grow up in a world without DOMA, and those same children who happen to be gay will be free to love and get married,” she said. In the second case, the court said that it could not rule on a challenge to Proposition 8, a ban on gay marriage in California passed by voters there in 2008, because supporters of the ban lacked the legal standing to appeal a lower court’s decision against it. The court did not rule on the constitutionality of gay marriage, but the effect of the decision will be to allow same-sex marriage to resume in California. That decision was also 5-4, written by Chief Justice John Roberts. Lt. Gavin Newsom told NBC News that gay marriage would resume in California within 30 days. Gov. Jerry Brown said counties could begin issuing marriage licenses to gay couples as soon as one formality was taken care of: A federal appeals court had to lift a stay issued by a lower judge. “As soon as they lift that stay, marriages are on,” California Attorney General Kamala Harris told reporters. “The wedding bells will ring.” The two rulings, released minutes apart, were greeted by jubilant cheers outside the Supreme Court, where crowds of gay-marriage supporters waved rainbow banners and flags bearing symbols of equality, and at City Hall in San Francisco. “The underlying message, I think, is that these are marriages, these are relationships, that are worthy of equal respect,” said Tom Goldstein, the publisher of SCOTUSblog and a Supreme Court analyst for NBC News.  “It really does send a powerful message to the country that this is something that deserves fair treatment. President Barack Obama placed a phone call from Air Force One to the two gay couples who had challenged Proposition 8. He told them, “We’re proud of you guys.” Paul Katami, one of the challengers, invited the president to his wedding to his partner, Jeff Zarrillo. David Boies, a lawyer who argued against Proposition 8, said that the rulings took the country closer to realizing the Declaration of Independence’s guarantee that all men are created equal. “It’s a wonderful day for America,” he said. The decisions were handed down 10 years to the day after the court decided Lawrence v. Texas, which struck down anti-sodomy laws across the country. They also came just ahead of the weekend when many large cities celebrate gay pride by observing the anniversary of the Stonewall riots, considered the beginning of the gay rights movement. Opponents of gay marriage vowed to fight on in the states. “We clearly have a mixed ruling here,” said John Eastman, chairman of the National Organization for Marriage. “Justice Kennedy did not say that all states must recognize same-sex marriage. In fact, his opinion is full of deference to the states’ determination of marriage policy.” Under the Defense of Marriage Act, gay couples who are legally married in their states were not considered married in the eyes of the federal government, and were ineligible for the federal benefits that come with marriage. Not counting California, 12 states and the District of Columbia have authorized gay marriage. The law had helped determine who is covered by more than 1,100 federal laws, programs and benefits. They include a tax exemption for health benefits for gay spouses, and the right to petition the government for a green card. Defense Secretary Chuck Hagel said he was looking forward to extending benefits to gay military spouses. All had been prohibited under DOMA. The Supreme Court ruling said that the law had instructed federal officials, “and indeed all persons with whom same-sex couples interact, including their own children, that their marriage is less worthy than the marriages of others.” The case before the Supreme Court concerned Windsor and Thea Spyer, a lesbian couple who lived together in New York for 44 years and married in Canada in 2007. When Spyer died in 2009, Windsor was hit with $363,000 in federal estate taxes. Had the couple been considered by the federal government to be married, Windsor would not have incurred those taxes.  “We won everything we asked and hoped for,” Windsor told reporters. Kennedy was joined in the majority by the four members of the court’s liberal wing — Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan. Dissenting were Roberts and Justices Antonin Scalia, Clarence Thomas and Samuel Alito. Scalia, in his dissent, wrote: “It is enough to say that the Constitution neither requires nor forbids ou rsociety to approve of same-sex marriage, much as it neither requires nor forbids us to approve of no-fault divorce, polygamy, or the consumption of alcohol.” President Bill Clinton signed the act into law in September 1996. A court ruling in Hawaii had raised the prospect that that state might become the first to authorize gay marriage. Some members of Congress believed that the law might take the air out of a movement to amend the Constitution to block gay marriage. Proposition 8, the California ban, was approved by voters in 2008 with 52 percent of the vote. The measure was placed on the ballot after the California Supreme Court allowed same-sex marriage. The push to overturn it drew endorsements from what might have seemed unusual quarters just a few years ago. In the days before the Prop 8 case was argued, politicians, business leaders, professional athletes and other high-profile figures rushed to announce their support for gay marriage. Dozens of Republicans added their names to a paper known as a friend-of-the-court brief that argued that gay marriage promotes the conservative values of stability and mutual obligation. And the case itself was argued, up through the federal court system, by two unlikely partners: Boies and Theodore Olson, the lawyers on opposing sides of Bush v. Gore, the Supreme Court case that settled the 2000 presidential election.

SAN DIEGO (AP) — Move over vampires, goblins and haunted houses, this kind of Halloween terror aims to shake up even the toughest warriors: An untold number of so-called zombies are coming to acounterterrorism summit attended by hundreds of Marines, Navy special ops, soldiers, police, firefighters and others to prepare them for their worst nightmares.

"This is a very real exercise, this is not some type of big costume party," said Brad Barker, president of Halo Corp, a security firm hosting the Oct. 31 training demonstration during the summit at a 44-acre Paradise Point Resort island on a San Diego bay. "Everything that will be simulated at this event has already happened, it just hasn't happened all at once on the same night. But the training is very real, it just happens to be the bad guys we're having a little fun with."

Hundreds of military, law enforcement and medical personnel will observe the Hollywood-style production of a zombie attack as part of their emergency response training.

In the scenario, a VIP and his personal detail are trapped in a village, surrounded by zombies when a bomb explodes. The VIP is wounded and his team must move through the town while dodging bullets and shooting back at the invading zombies. At one point, some members of the team are bit by zombies and must be taken to a field medical facility for decontamination and treatment.

"No one knows what the zombies will do in our scenario, but quite frankly no one knows what a terrorist will do," Barker said. "If a law enforcement officer sees a zombie and says, 'Freeze, get your hands in the air!' What's the zombie going to do? He's going to moan at you. If someone on PCP or some other psychotic drug is told that, the truth is he's not going to react to you."

The keynote speaker beforehand will be a retired top spook — former CIA Director Michael Hayden.

"No doubt when a zombie apocalypse occurs, it's going to be a federal incident, so we're making it happen," Barker said. Since word got out about the exercise, they've had calls from "every whack job in the world" about whether the U.S. government is really preparing for a zombie event.

Called "Zombie Apocalypse," the exercise follows the federal Centers for Disease Control and Prevention's campaign launched last year that urged Americans to get ready for a zombie apocalypse, as part of a catchy, public health message about the importance of emergency preparedness.

The Homeland Security Department jumped on board last month, telling citizens if they're prepared for a zombie attack, they'll be ready for real-life disasters like a hurricane, pandemic, earthquake or terrorist attack. A few suggestions were similar to a few of the 33 rules for dealing with zombies popularized in the 2009 movie "Zombieland," which included "always carry a change of underwear" and "when in doubt, know your way out."

San Diego-based Halo Corp. founded by former military special ops and intelligence personnel has been hosting the annual counterterrorism summit since 2006.

The five-day Halo counterterrorism summit is an approved training event by the Homeland Security Grant Program and the Urban Areas Security Initiative, which provide funds to pay for the coursework on everything from the battleground tactics to combat wounds to cybersecurity. The summit has a $1,000 registration fee and runs Oct. 29-Nov 2.

Conferences attended by government officials have come under heightened scrutiny following an inspector general's report on waste and abuse at a lavish 2010 Las Vegas conference that led to the resignation of General Services Administrator Martha Johnson. The Las Vegas conference featured a clown, a mind-reader and a rap video by an employee who made fun of the spending.

Joe Newman, spokesman of the watchdog organization Project on Government Oversight, said he does not see the zombie exercise as frivolous.

"We obviously are concerned about any expenditure that might seem frivolous or a waste of money but if they tie things together, there is a lesson there," Newman said. "Obviously we're not expecting a zombie apocalypse in the near future, but the effects of what might happen in a zombie apocalypse are probably similar to the type of things that happen in natural disasters and manmade disasters. They're just having fun with it. We don't have any problems with it as a teaching point."

Defense analyst Loren Thompson agreed.

"The defining characteristics of zombies are that they're unpredictable and resilient. That may be a good way to prepare for what the Pentagon calls asymmetric warfare," Thompson said.

Organizers can also avoid the pitfalls of using a mock enemy who could be identified by nationality, race or culture — something that could potentially be seen as offensive.

"I can think of a couple of countries where the local leaders are somewhat zombie-like," he joked. "But nobody is going to take this personally."

California Gov. Signs Bill Allowing Non-Doctors to Perform Abortions.

Over the weekend, Governor Jerry Brown (D-Calif.) signed legislation that expands a controversial trial program allowing less-trained members of the medical community to provide abortions.

Whereas typically only licensed doctors can perform the delicate procedure, the bill states that due to a shortage of doctors, now a number of certified nurses, midwives, and physician assistants are also qualified.
Sen. Christine Kehoe (D-San Diego), who introduced the bill, said its purpose is to expand access to abortion for women, particularly those in rural areas where abortionists are apparently harder to find.
Supported by Planned Parenthood Affiliates of California and the American Civil Liberties Union of California, the procedure has the novices using a tube to “empty” the uterus with a suction, according to Silicon Valley’s Mercury News.

The California Pro-Life Council sent a legislative alert asking for pro-life residents of the state to contact the governor to urge him to veto it.
…“Since [the program's] inception 41 nurse-midwives, nurse-practitioners and physician assistants have been trained to kill unborn children.  The purpose of this training, funding by abortion businesses and sympathizers is designed to expand the pool people will to perform abortions.  Already abortions can result in serious injury and death to mothers and of course almost always the unborn child.”
“The materials presented in this training teach these newbies to the abortion industry how to validate the ‘moral’ decision to kill unborn children,” CPLC added.

Brown also signed a bill allowing more nurses, midwives, and physician assistants to prescribe birth control pills, patches, and rings to women.
“At a time when some seek to turn back the clock and restrict women’s health choices, California is expanding access to birth control and reaffirming every woman’s basic Constitutional rights,” Brown said.
Planned Parenthood President Cecile Richards added: “by enacting this bill, California [is] once again setting an example of national leadership at a critical time when access to healthcare is under attack.”

The Californian city of Lancaster will be the first to experience a “new era in law enforcement surveillance” with residents set to be watched by a permanent eye in the sky which will beam constant video footage back to police headquarters including crimes in progress as well as “scenes of mundane day-to-day life.”

A Cessna plane fitted with sophisticated video surveillance technology will fly loops around the city and send footage directly back to a Los Angeles County Sheriff’s Department dispatch center. Officials plan to add a second aircraft to the arsenal at a later date.

“About a few hours into its maiden flight Friday, the plane’s video feed captured its first incident: a motorcycle rider who had crashed at 20th Street East and Avenue K. Using the video, deputies in the dispatch were able to help paramedics assess the situation before they got to the scene. Later, the department got word that a group fight was brewing at Eastside High School. The plane moved into position and conducted surveillance above the campus. No fight occurred,” reports the L.A. Times.

According to a report by ABC 7, the camera can zoom in to a person walking down the street from three miles away. The system also has a 5 second response time, meaning it can swiftly pinpoint a car and track its movements indefinitely.

Despite claims that the surveillance system will only target crimes in progress, officials admit that the video footage will be stored for two years and can be reviewed in case a crime or suspect was “unwittingly” captured on camera.

Despite the fact that Mayor R. Rex Parris admits the city is cash-strapped, $1.3 million dollars a year will be invested into the project, the same amount of money it would cost to pay for five police patrol cars each with a two deputy crew.

Lancaster resident David Abber called the program a “violation of the Fourth Amendment.” The ACLU looked into the matter and came back with a lukewarm response, stating that some of their fears had been allayed but not all.

The program is unprecedented because, as the L.A. Times notes, “Lancaster appears to be the first city where a camera will send video continuously to the ground, to be used as an integral part of daily policing.”

As we have previously highlighted, the idea of having a permanent eye in the sky, whether that be via manned aircraft or surveillance drones, remains the priority of law enforcement bodies across the country despite the significant costs involved during a time of economic hardship when some cities are struggling to afford vital services such as firefighters.

Last year, the Ogden Police Department applied to fly an unmanned surveillance blimp at a height of just 400 feet over high crime areas of the city to watch for “suspicious activity.”

The use of surveillance drones and blimps to carry out sweeping surveillance of the public with total disregard for privacy rights is expected to accelerate in the coming years. The FAA has forecast that 30,000 surveillance drones will be in U.S. skies by the end of the decade.

Last month, Secretary of the Department of Homeland Security Janet Napolitano told a House Committee on Homeland Security that the federal agency was working on deploying drones for purposes of “public safety.”

As we reported earlier this year, the DHS is already using another type of airborne drone surveillance, also utilized to track insurgents in Afghanistan and Iraq, for the purposes of “emergency and non-emergency incidents” within the United States.

Planned Parenthood Group Launches 40-Day “Prayer” Campaign for Abortion Industry

A Planned Parenthood group in California has launched a pro-abortion “prayer” campaign “in celebration of women and reproductive rights.” The project, entitled “40 Days of Prayer to Keep Abortion Safe and Legal,” is sponsored by Six Rivers Planned Parenthood in Eureka, California, and features 40 different prayers individuals can offer for those involved in the abortion process: the mothers, escorts, abortionists performing the procedure — everyone, it seems, except the babies destroyed by abortion. The effort runs from March 18 through April 27.

The Rev. Rebecca Turner of Faith Aloud, one of the sponsors of the project, explained to Focus on the Family’s Citizen Link that the “prayer” initiative is based on the belief that “abortion is a very private decision that women do often make. One-third of all American women do make this decision at some point in their lives, and we want them to know that God loves them in every situation, and whether they choose abortion or choose to have a child, whatever their decision, that God’s love is always present for them.”

Turner said that those involved “pray for women who are making difficult choices, we pray for pregnant women, we pray for the doctors who work in clinics, we pray for everyone who may be involved” — but not for the pre-babies.

While it is impossible to ignore the obvious similarities, the pro-abortion minister insisted that her group’s prayer campaign was not intended as a challenge to 40 Days for Life, the annual initiative during which pro-life individuals and groups pray for an end to abortion. She did, however claim that the pro-life prayer project was “misguided ... because it completely eliminates the woman. And it is the pregnant woman that we are concerned for.”

She emphasized that “instead of praying for unborn children, you know, we’re praying for those women, and we’re praying that they find within their own faith a strength, and that they don’t make decisions out of shame, that they don’t feel shame that’s imposed upon them by anybody else, whether it be family members or religious authorities or whatever, but instead to look to their own faith for strength and confidence, and to do what’s best for themselves.”

As for the babies killed by abortion, the Rev. Turner said that they are less significant than adults. “I do not, I cannot equate that early embryonic life with your life,” she told the CitizenLink reporter. “I see your life as having more significant value than that life that is in the earliest stages of development, and I don’t think it’s anyone else’s right to make a decision for a woman about when she’s ready to become a mother and when she’s physically capable of carrying a child to term.”

She expressed her view that “God has always given us, not just the right but the responsibility as women, for knowing when is the right time to start a family and to bring a child into the world, and that it’s irresponsible to bring a child into the world when the community is not ready for it.”

Pro-life and Christian groups reacted to news of the pro-abortion “prayer” initiative with predictable indignation. For example, Liberty Counsel, a pro-family legal advocacy group, noted that on day 35 of the pro-abortion campaign, participants are encouraged to pray that “girls everywhere” will have the opportunity to live lives filled with good health, education, recreation, and vocational choices. “Ironically, this prayer excludes girls who are in utero,” noted a Liberty Counsel press release. “It also offensively insinuates that mothers are incapable of becoming educated, enjoying art, being healthy, or holding a job.”

The pro-family group noted that Planned Parenthood’s larger campaign “to dehumanize children based on their age is similar to a tactic once used in Nazi Germany towards the Jews and other non-Arians: first ostracize them from the rest of society, and then annihilate them. Planned Parenthood’s attempts to develop a ‘spiritual’ aspect to the pro-abortion argument can seem comparable to the religious leaders in Germany who supported Adolf Hitler and the Nazis. It was wrong then and it is wrong now.”

Said Liberty Counsel’s founder and chairman, Matthew Staver: “As much as they might not like the comparison, Planned Parenthood today is no different than the eugenics promoted by its founder Margaret Sanger who advocated the elimination of ‘undesirables,’ just like the most famous eugenicist, Adolf Hitler.”

Among the “prayers” the pro-abortion group is offering in its 40-day vigil are:

• “Day 1: Today we pray for women for whom pregnancy is not good news, that they know they have choices.”

• “Day 5: Today we pray for medical students who want to include abortion care in their practice. May they receive good training and find good mentors.”

• “Day 7: Today we pray for the 45 million American women who have had safe, legal abortions. May they stand tall and refuse shame.”

• “Day 11: Today we pray for better access to all forms of birth control.”

• “Day 18: Today we pray for all the staff at abortion clinics around the nation. May they be daily confirmed in the sacred care that they offer women.”

• “Day 34: Today we give thanks for abortion escorts who guide women safely through hostile gauntlets of protestors.”

• “Day 36: Today we pray for the families we’ve chosen. May they know the blessing of choice.”

• “Day 38: Today we pray for a cloud of gentleness to surround every abortion facility. May everyone feel calm and loving.”

• “Day 40: Today we give thanks and celebrate that abortion is still safe and legal.”

By contrast to the pro-abortion prayer campaign, since its inception in 2007 the global 40 Days for Life initiative has documented nearly 6,000 children saved from abortion, the closing of 22 abortion clinics, and 69 abortion providers abandoning the business of killing babies.

Dave Bereit, national director for 40 Days for Life, told LifeSiteNews.com that while it is difficult to ignore the pro-abortion group’s efforts to imitate his organization’s pro-life prayer initiative, “when that imitation is being used to promote the killing of innocent children, we are anything but flattered.”

He added that “Planned Parenthood has stooped to a new low by exploiting pastors and churches to ‘celebrate’ the slaughter of babies made in God’s image and likeness. They certainly wouldn’t be doing this if 40 Days for Life wasn’t having a devastating impact on their abortion business!”
