Judge Napolitano Slams Obama’s SCOTUS Criticism: ‘No Pres. Has Questioned This Since Andrew Jackson!’

Appearing on Fox and Friends Tuesday, Judge Andrew Napolitano took a swipe at President Obama‘s demand to the Supreme Court to not overturn his health care law, calling it incomprehensible and desperate.

“We were scratching our heads when we were watching this and had it played over and over again because this is a graduate of Harvard Law School, the head of the Harvard Law Review and he taught constitutional law review at the University of Chicago,” said Napolitano. “Two of the best law schools in the country and he’s rejecting a basic premise of American law that’s not been seriously questioned in 175 years, which is this: the courts have the right to review what the Congress does and what the President does and if the court finds that behavior unconstitutional, they can void, they can invalidate what the Congress and the what the President does. That’s our system. That’s what preserves the Constitution against the tyranny of the majority. No president has questioned this since Andrew Jackson!”

“Could he possibly have been saying look, if this is not upheld, the ruling would be illegitimate and I’m really kind of talking to Justice Kennedy over there who is probably a swing vote. You have three months. I vote you say it’s okay?”

“That’s why we have a life tenured independent judiciary so that it cannot be cowed by politicians no matter how well intended they may be,” Napolitano said. “Look, if this is invalidated, the President can say this was invalidated by the court not by me. If this is upheld, the President can say look, even a court appointed by a Republican president upheld this but for him to question the power and ability and authority of the court to review it and to decide if it’s unconstitutional is incomprehensible.

“Kind of looks like he’s declared war on the Supreme Court,” Doocy surmised.

“Kind of looks like he’s desperate,” Napolitano hit back.

Muslim Kills Daughter For Having US. Actors On Her Mobile Phone.

An Algerian man used a kitchen knife to slaughter his 16-year-old daughter after discovering pictures of American and Turkish actors in her mobile phone.

The man, identified as B. Majeed, sent his second wife and her children to her family so he could be left alone with his teen age daughter, Lidya.

“After finding photographs of some American and Turkish actors in her mobile phone, the father decided to kill his daughter and made plans for the murder,” the Algerian Arabic language daily Al Nahar said.

“When he was alone with her at home, he grabbed her and put the knife on her neck…he then slaughtered her like a sheep.”

The paper said the man, who had Lidya from his first wife, then phoned the police and surrendered to them

Technology is taking an ever larger role in the systems we rely on every day. The military is not immune to this, and in fact helps push forward innovation if it benefits them. Multiple projects funded by DARPA prove this.

However, we have seen a fictional take on where too much reliance on machines and automation can lead. Yes, I’m referring to Skynet as depicted in the Terminator movies. Now it seems the US Department of Defense is heading in exactly that direction with its research projects and investment.

Zachary J. Lemnios holds the position of Assistant Secretary of Defense for Research and Engineering in the US Government. Yesterday he released a letter entitled, “The Department of Defense Is Placing a Big Bet on Big Data.” through a new government site called the Defense Innovation Marketplace. It broadly outlines how new systems are being developed and brought online to “understand and interpret” the growing amount of data being gathered by military sensors.

That’s not the worrying bit, though. These so-called Big Data projects have a $250 million budget to spend every year, and one of the projects underway could be named Skynet it’s so close to the artificial intelligence seen in the movies.

The project does not have a name yet, but it could be multiple projects as far as we know. The aim is clear, though. The DoD wants to create a system that combines sensing, perception, and the ability to make decisions to create a “truly autonomous system.” The end result? A system that will be “agile … maneuver and understand their environment … make decisions by themselves … know when to call upon a human.”

I think they should call it the T-100 as it’s a first attempt, don’t you?

To achieve this intelligent, autonomous system the DoD is investing heavily in tools and techniques to analyze large amounts of data, that offer the ability to understand and react to real-world conditions, and act dynamically without human intervention. So basically a network of machines acting on their own based on the situation and commands sent down from a central command system.

There is also a call for ideas to aid the project with 20 open solicitations available. Who is going to step up and offer to develop a foolproof kill switch?

Obama Warns 'Unelected' Supreme Court Against Striking Down Health Law.

President Obama, employing his strongest language to date on the Supreme Court review of the federal health care overhaul, cautioned the court Monday against overturning the law -- while repeatedly saying he's "confident" it will be upheld.

The president spoke at length about the case at a joint press conference with the leaders of Mexico and Canada. The president, adopting what he described as the language of conservatives who fret about judicial activism, questioned how an "unelected group of people" could overturn a law approved by Congress.

"I'm confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress," Obama said.

The Supreme Court spent three days hearing arguments last week in four separate challenges to the health care law, which stands as the president's signature domestic policy accomplishment. A central challenge was over the individual mandate -- the requirement that Americans buy health insurance. Critics say the mandate is unconstitutional, and that the federal government cannot force people into the insurance marketplace.

Obama on Monday said that without such a mandate, the law would not have a mechanism to ensure those with preexisting conditions get health care.

"I'm confident that this will be upheld because it should be upheld," Obama said, describing the law as "constitutional."

Republican lawmakers slammed the president for his Supreme Court comments. Sen. Orrin Hatch, R-Utah, accused the president of misrepresenting the implications of a ruling against the law.

"It must be nice living in a fantasy world where every law you like is constitutional and every Supreme Court decision you don't is 'activist,'" he said in a statement. "Many of us have been arguing for nearly three years that the federal government does not have the power to dictate individuals' purchasing decisions. After a national debate on the subject, more than two-thirds of Americans agree that the Obamacare insurance mandate is unconstitutional."

The president spoke following meetings with Mexican President Felipe Calderon and Canadian Prime Minister Stephen Harper. Until the heath care case remarks, the press conference was focused mostly on economic issues, as well as the war on drugs.

The leaders vowed a new effort to boost North American trade and cut needless regulation that stifles it. "Our three nations are going to sit down together, go through the books and simplify and eliminate more regulations that will make our joint economies stronger," Obama said.

Obama noted trade among the three neighbors now tops $1 trillion a year, and he wants to see that number rise.

But notable by its absence from the post-summit news conference in the Rose Garden was the controversial Keystone XL oil pipeline from Canada's oil sands in Alberta to the U.S. Gulf of Mexico. Obama shelved the plan pending further review -- and has endured ferocious GOP attacks ever since, with Republicans calling the move a blow to job creation and U.S. energy needs. He maintains GOP leaders in Congress forced his hand by insisting on a decision before an acceptable pipeline route was found.

Harper has voiced disappointment with Obama's decision. He also visited China in February to explore alternatives. Canada has the world's third-largest oil reserves -- more than 170 billion barrels -- after Saudi Arabia and Venezuela, and daily production of 1.5 million barrels from the oil sands is expected to rise to 3.7 million by 2025.

Faster, Higher, Deadlier: US Plans Nuclear Drones

The United States is planning on building nuclear-powered drones. The innovation will allow an increase in flying time "from days to months," leaving more power available for operating equipment.

­Research for the project was conducted by Sandia National Laboratories, the US government's principal nuclear research and development agency, and defense contractor Northrop Grumman, the Guardian reports.

The technology is to deal with three problems facing the US’ current drone arsenal: insufficient flying time over a potential target, lack of power for running surveillance and weapons systems, and lack of communications capacity.

The team looked at numerous different power systems for large- and medium-sized drones before settling on the nuclear solution.

The research summary deems the technology as highly efficient, saying the results of the research are “to be used in the next generation of unmanned air vehicles used for military and intelligence applications."

However, there is a big concern over safety as drones have a tendency to crash – and should a nuclear-powered drone fall into the hands of terrorists or unfriendly powers, the consequences could be devastating.
